1. Everyone will know I've filed for bankruptcy. Unless you're a prominent person or a major corporation and the filing is picked up by the media, the chances are very good that the only people who will know about a filing are your creditors. While it's true that bankruptcy is a public legal proceeding, the number of people filing is so massive that very few publications have the space, manpower or inclination to run all of them, although some local newspapers do print the names of those who have filed in that community.
2. All debts are wiped out in Chapter 7 bankruptcy. You wish. Certain types of debts cannot be discharged, or erased. They include child support and alimony, student loans, restitution for a criminal act and debts incurred as the result of fraud.
3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.
"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.
While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.
"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).
4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.
5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.
6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.
7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.
8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.
9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Unlike other negatives, which stay on your report for seven years, bankruptcy can be there for 10 years, but you do get to rebuild your credit eventually.
10. You can't get rid of back taxes through bankruptcy. Generally speaking, this is true. However, there is such a thing as tax bankruptcy.
11. You can only file for bankruptcy once. The truth is, you can file for Chapter 7 bankruptcy only once every eight years, says Justin Harelik, Bankrate's bankruptcy adviser. For Chapter 13 reorganization, you can file more often than that.
Of course, that doesn't make it a good idea.
"Multiple bankruptcies are really bad," Rosenberg says. "Many people get into the habit of once they've done it, it becomes a way of life. This is not good for your karma." Or your credit rating.
12. I can max out all my credit cards, file for bankruptcy and never pay for the things I bought.That's called fraud, and bankruptcy judges can get really cranky about it.

Creditor Problems? Debt Collectors Calling? Things To Consider Before Filing An Affordable Bankruptcy
Receiving calls from debt collectors? If you’re trying to get creditors to stop calling, you may want to change your phone number instead of immediately filing for bankruptcy. When filing bankruptcy, timing is everything. Waiting just a few weeks could be the difference of having recently transferred property seized or having extra debt tacked on to your bills.
Here are five situations where it’s better to wait before filing an Affordable Bankruptcy with the law firm of Schlyer & Associates.
1. If you’re going to have more debt soon. When you file bankruptcy, all of your debts leading up to that point are exonerated. But if you know you are going to have an expense in the near future, like a surgery planned months in advance, wait to file until after the surgery is over. If you file before, you will still have to pay the costs of the surgery.
2. If your income just dropped. When you originally file for Chapter 7 bankruptcy, the court will look to your income over the past six months to see if you have the means to pay off your debts. If you were recently laid off but your previous income was high, you may only be eligible for Chapter 13 bankruptcy, which still requires you pay off some portion of the debt. If you wait to show that your income has significantly decreased, you will be able to qualify for Chapter 7.
3. If you have an unspent tax refund. Wait to file until after you spend your tax refund because once you file, it will become part of your bankruptcy estate and will be used to pay off creditors. But when you use it, make sure you spend your refund on necessities like a mortgage payment, utilities, food, clothing, medical care, car payments or education. If you spend it on anything else, it will affect your case.
4. If you’ve bought luxury goods within 90 days of filing. If you spend $550 on luxury items within 90 days of filing for bankruptcy, the court will question if you ever intended on paying the debt back. Once you file for bankruptcy, your debt could be denied discharge because of bad faith and you will still have to pay back the debt during bankruptcy.
5. If you’re trying to get rid of student loans. Since the Bankruptcy Consumer and Protection Act passed in 2005, student loans are no longer forgiven in bankruptcy. But more graduates than ever – 13.4 percent – are defaulting on their loans just three years after starting to pay them off, according to the most recent Department of Education Statistics available. If your loans go into collection, stay calm. Don’t panic and file Chapter 7 bankruptcy because it simply won’t help.

Due to Fire Hazard Briggs & Stratton Recalls Compact Snow Blowers
The attorneys at Schlyer & Associates, the Aggressive Trial Lawyers, warn of a recall issued by the U.S. Consumer Product Safety Commission of 5,400 Briggs & Stratton Ariens Snow-Thro 24 inch snow blowers.
According to the recall notice, the snow blower's carburetor bowl nut can allow gas to escape from the unit, which can result in a fire hazard. The recalled snow blower is 24-inches wide and comes in orange with black.

The recalled snow blowers were sold at Ariens dealers and The Home Depot nationwide from August through September 2012 for about $800 to $1000.

1. Everyone will know I've filed for bankruptcy. Unless you're a prominent person or a major corporation and the filing is picked up by the media, the chances are very good that the only people who will know about a filing are your creditors. While it's true that bankruptcy is a public legal proceeding, the number of people filing is so massive that very few publications have the space, manpower or inclination to run all of them, although some local newspapers do print the names of those who have filed in that community.
2. All debts are wiped out in Chapter 7 bankruptcy. You wish. Certain types of debts cannot be discharged, or erased. They include child support and alimony, student loans, restitution for a criminal act and debts incurred as the result of fraud.
3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.
"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.
While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.
"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).
4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.
5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.
6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.
7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.
8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.
9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Unlike other negatives, which stay on your report for seven years, bankruptcy can be there for 10 years, but you do get to rebuild your credit eventually.
10. You can't get rid of back taxes through bankruptcy. Generally speaking, this is true. However, there is such a thing as tax bankruptcy.
11. You can only file for bankruptcy once. The truth is, you can file for Chapter 7 bankruptcy only once every eight years, says Justin Harelik, Bankrate's bankruptcy adviser. For Chapter 13 reorganization, you can file more often than that.
Of course, that doesn't make it a good idea.
"Multiple bankruptcies are really bad," Rosenberg says. "Many people get into the habit of once they've done it, it becomes a way of life. This is not good for your karma." Or your credit rating.
12. I can max out all my credit cards, file for bankruptcy and never pay for the things I bought.That's called fraud, and bankruptcy judges can get really cranky about it.

6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.

Be Careful - Children Drowning in Bathtubs, Bath Seats and Buckets

Discovery Kids Lamps Recalled Due To Burn & Fire Hazard
The Merrillville Indiana personal injury law firm, Schlyer & Associates, the Aggressive Trial Lawyers is warning of a recall issued by the U.S. Consumer Product Safety Commission of about 300,000 Discovery Kids™ Animated Marine and Safari Lamps imported by Innovage LLC, of Foothill Ranch, California.
According to the recall notice, the placement of internal wires near the circuit board can cause electrical short-circuiting and sparking, posing a fire and a burn hazard to consumers.

The recalled lamps were sold at Bed Bath & Beyond, Bonton, JCPenney, Kohls, Office Max, Toys "R" Us stores nationwide as well as the online retailers Amazon, Ideeli, JCPenney, Kohls, Macy's and Overstock from June 2010 through March 2012 for between $10 and $20.
If you have one of the recalled lamps, you should immediately stop using the lamps and contact Innovage at (888) 232-1535 for instructions on how to obtain a full refund.

With a mind toward declawing the monster, here are a dozen misconceptions about filing or declaring bankruptcy:
1. Everyone will know I've filed for bankruptcy. Unless you're a prominent person or a major corporation and the filing is picked up by the media, the chances are very good that the only people who will know about a filing are your creditors. While it's true that bankruptcy is a public legal proceeding, the number of people filing is so massive that very few publications have the space, manpower or inclination to run all of them, although some local newspapers do print the names of those who have filed in that community.
2. All debts are wiped out in Chapter 7 bankruptcy. You wish. Certain types of debts cannot be discharged, or erased. They include child support and alimony, student loans, restitution for a criminal act and debts incurred as the result of fraud.
3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.
"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.
While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.
"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).
4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.
5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.
6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.
7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.
8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.
9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Due to Shock Hazard Big Lots Recalls Floor Lamps
The Aggressive Trial Lawyers, Schlyer & Associates, based in Merrillville, Indiana is warning of a recall issued by the U.S. Consumer Product Safety Commission of 43,700 Five-Light Floor Lamps sold by Big Lots stores.
According to the recall notice, the wiring for the lamp’s light sockets can become exposed, posing a risk of electric shock to consumers. In addition, use of the recommended standard 40 watt light bulbs can generate excessive heat, which can melt the double plastic shades over the bulbs.

The recalled lights were sold only at Big Lots stores nationwide from April 2010 through November 2011 for between $30 and $50.

Bankruptcy Myths You Should Know About

With a mind toward declawing the monster, here are a dozen misconceptions about bankruptcy:
1. Everyone will know I've filed for bankruptcy. Unless you're a prominent person or a major corporation and the filing is picked up by the media, the chances are very good that the only people who will know about a filing are your creditors. While it's true that bankruptcy is a public legal proceeding, the number of people filing is so massive that very few publications have the space, manpower or inclination to run all of them, although some local newspapers do print the names of those who have filed in that community.
2. All debts are wiped out in Chapter 7 bankruptcy. You wish. Certain types of debts cannot be discharged, or erased. They include child support and alimony, student loans, restitution for a criminal act and debts incurred as the result of fraud.
3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.
"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.
While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.
"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).
4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.
5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.
6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.
7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.
8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.
9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Unlike other negatives, which stay on your report for seven years, bankruptcy can be there for 10 years, but you do get to rebuild your credit eventually.
10. You can't get rid of back taxes through bankruptcy. Generally speaking, this is true. However, there is such a thing as tax bankruptcy.
11. You can only file for bankruptcy once. The truth is, you can file for Chapter 7 bankruptcy only once every eight years, says Justin Harelik, Bankrate's bankruptcy adviser. For Chapter 13 reorganization, you can file more often than that.
Of course, that doesn't make it a good idea.
"Multiple bankruptcies are really bad," Rosenberg says. "Many people get into the habit of once they've done it, it becomes a way of life. This is not good for your karma." Or your credit rating.
12. I can max out all my credit cards, file for bankruptcy and never pay for the things I bought.That's called fraud, and bankruptcy judges can get really cranky about it.

Toyota Recalling 420,000 Vehicles

There are two basic types of bankruptcy available for people (not corporations). A Chapter 7 is a liquidation of all unsecured debt with the option of retaining or returning secured property. That sounds very impressive and lawyer-like doesn’t it? To say it another way, in a Chapter 7 you list all the debt you owe and you can keep the debt you decide to pay for, like a house or a car. The other debts, like credit cards, medical bills, signature loans, payday loans and mail order things, are discharged (or forgiven) and you would never have to pay those debts. If you decide you cannot afford to keep your house or a car, you have the option of giving the property back and owing that creditor nothing.
Chapter 13 Bankruptcy
A Chapter 13 is a reorganization of debt, a lot like credit counseling without the late fees, interest and collections. In a Chapter 13 we put together a budget based on your net income and your everyday routine living expenses (not including your debts, mortgage or car payments). This formula gives us an excess amount of income available for repayment of your debts. Once we agree this figure is accurate, we file your bankruptcy and that amount is paid to a trustee on a monthly basis and he pays your debts for you. He will focus first on secured debts, like a mortgage and cars. If he has money left over he will then make a distribution to your unsecured creditors. While you bankruptcy is pending creditors cannot attempt to collect the debt. At the end of your Chapter 13, your unsecured debts would be discharged and you would go back to making your mortgage payment.

Affordable Bankruptcy Lawyers Answer What Is Secured Debt

What is secured debt? Generally speaking, it means you purchased something on credit and you have their property. It is a house, a car or motorcycle. Those are considered secured debts as long as you still have the property.
What is an unsecured debt? A unsecured debt is a credit card that you can use anywhere in any store. If you use your VISA or Mastercard to buy CDs or a pair of shoes, the credit card company does not get/keep an interest in that property, it is unsecured.
On the other hand, if you take out a loan for a car, the loan documents specify that the loan is for a car and the creditor retains a security interest in the property until the property is paid off, the loan is secured.
Does it matter if my debt is secured or unsecured if I file bankruptcy? In a bankruptcy, you must decide what you want to do with secured debt. If you want to keep the property, the house or car, you must make arrangements to continue making your required monthly payment. This is known as a Reaffirmation. If you want to keep the house or car, the debt is listed on your bankruptcy and then you can ‘reaffirm” or keep the property by making your payments.
On the other hand, if you no longer want to keep the house or car, you can surrender back the property to the creditor and owe them nothing. Once the property is surrendered back to the creditor, the remaining balance becomes unsecured and is discharged.
Can I have an example? Borders Likely To Close Highland, Indiana Store Soon
Borders Books, the bankrupt 40-year-old bookseller, announced Monday that it will ask the bankruptcy court to liquidate and close all of its remaining stores, after no last-minute savior emerged for the company, the Affordable Bankruptcy law firm of Schlyer & Associates is advising.
Borders liquidation plan will be presented to the federal judge overseeing the company's bankruptcy case on Thursday.
What is left to unwind are Borders' 399 stores, about two-thirds of the locations it operated when it filed for bankruptcy in February. It currently has 10,700 employees, including the store in Highland, Indiana.
It appears Borders will begin closing its remaining stores as soon as Friday, with the liquidation sale expected to run through September if approved by the bankruptcy court.
