Receiving calls from debt collectors?  If you’re trying to get creditors to stop calling, you may want to change your phone number instead of immediately filing for bankruptcy. When filing bankruptcy, timing is everything. Waiting just a few weeks could be the difference of having recently transferred property seized or having extra debt tacked on to your bills.

Here are five situations where it’s better to wait before filing an Affordable Bankruptcy with the law firm of Schlyer & Associates.

1. If you’re going to have more debt soon. When you file bankruptcy, all of your debts leading up to that point are exonerated. But if you know you are going to have an expense in the near future, like a surgery planned months in advance, wait to file until after the surgery is over. 2. If your income just dropped. When you originally file for Chapter 7 bankruptcy, the court will look to your income over the past six months to see if you have the means to pay off your debts. If you were recently laid off but your previous income was high, you may only be eligible for Chapter 13 bankruptcy, which still requires you pay off some portion of the debt. If you wait to show that your income has significantly decreased, you will be able to qualify for Chapter 7.

3. If you have an unspent tax refund. Wait to file until after you spend your tax refund because once you file, it will become part of your bankruptcy estate and will be used to pay off creditors. But when you use it, make sure you spend your refund on necessities like a mortgage payment, utilities, food, clothing, medical care, car payments or education. If you spend it on anything else, it will affect your case.

4. If you’ve bought luxury goods within 90 days of filing. If you spend $550 on luxury items within 90 days of filing for bankruptcy, the court will question if you ever intended on paying the debt back. Once you file for bankruptcy, your debt could be denied discharge because of bad faith and you will still have to pay back the debt during bankruptcy.

5. If you’re trying to get rid of student loans. Since the Bankruptcy Consumer and Protection Act passed in 2005, student loans are no longer forgiven in bankruptcy. But more graduates than ever – 13.4 percent – are defaulting on their loans just three years after starting to pay them off, according to the most recent Department of Education Statistics available. If your loans go into collection, stay calm. Don’t panic and file Chapter 7 bankruptcy because it simply won’t help.

The attorneys at Schlyer & Associates, the Aggressive Trial Lawyers, warn of a recall issued by the U.S. Consumer Product Safety Commission of 800,000 Fisher-Price Newborn Rock 'n Play Sleepers.

According to the recall notice, mold can develop between the removable seat cushion and the hard plastic frame of the sleeper when it remains wet/moist or is infrequently cleaned, posing a risk of exposure to mold to infants sleeping in the product. The CPSC advises that mold has been associated with respiratory illnesses and other infections.

The recalled Fisher-Price Newborn Rock 'n Play Sleepers were sold at various mass merchandise stores nationwide and online since September 2009 for between $50 and $85. Units currently in retail stores are not affected by this recall to inspect. Only products that show signs of mold after use by consumers are included in this announcement.

The recalled washers were sold at Best Buy, Lowe’s, Sears, The Home Depot and other department and retail stores nationwide, from July 2008 to August 2011 for between $1,199 and $1,599.

The Northwest Indiana personal injury law firm, Schlyer & Associates, the Aggressive Trial Lawyers, is warning of a recall issued by the U.S. Consumer Product Safety Commission of 92,000 Sportspower BouncePro 14' Trampolines sold at WalMart stores.

According to the recall notice, the netting surrounding these trampolines can break, allowing children to fall through the netting and be injured.  Apparently, Sportspower has received 17 reports of the net breaking, resulting in 11 injuries including broken bones, back and neck injuries, and contusions.

The recalled trampolines were sold only at Walmart stores nationwide from February 2009 through February 2012 for about $275.

If you have one of the recalled trampolines, you should stop using the trampolines immediately and contact Sportspower at (888) 965-0565 to receive replacement black netting for the trampoline.

The Northwest Indiana personal injury law firm, Schlyer & Associates, the Aggressive Trial Lawyers, is warning of a recall issued by the U.S. Consumer Product Safety Commission of about 264,000 sippy cups sold at Target.

According to the recall notice, the Target Home Bunny Sippy Cup is being recall since the ear on the bunny sippy cup can poke a child in the eye area while using the cup for drinking, posing an injury hazard.

According to the notice, the recall involves two styles of Target Home Bunny Sippy Cups. The cups come with handles on both sides in pink and blue, female and male. Each contains a corresponding white bunny head screw-on lid and one bent ear and one straight ear. The cups can be identified by imprints on the bottom: "TARGET 200020683" for pink and "TARGET 200020884" for the blue.

The recalled cups were sold only at Target stores nationwide from February 2012 through April 5, 2012 for $3.

If you have any of the recalled cups sold at Target, you should immediately stop using the recalled sippy cups and return them to any Target store for a full refund or contact Target at (800) 440-0680.

The Northwest Indiana personal injury law firm, Schlyer & Associates, the Aggressive Trial Lawyers is warning of a recall issued by the U.S. Consumer Product Safety Commission of 304,000 Chefmate® 6-Speed Blenders sold at Target stores.

According to the recall notice, while in operation, the plastic pitcher can separate from the blade assembly, leaving the blade assembly in the base and exposing the rotating blades. This poses a laceration hazard to consumers.

According to the CPSC this recall affects all Chefmate® 6-Speed Blenders, model BL-10. The model number is located on the bottom of the base. The blender consists of a six-inch tall, white electrical base with five, white speed-selector buttons labeled 1 through 5, one gray button labeled “Pulse/Off” and the word “Chefmate®” in black letters on the front; a clear plastic pitcher with a handle with U.S. and metric volume measurement markings; a white plastic lid with a removable clear plastic lid stopper; and a white plastic blade assembly with two angled, stainless steel blades.

The recalled blenders were only sold at Target stores nationwide from September 2007 to February 2011 for about $14.

If you have one of the recalled blenders, you should immediately stop using the blenders and return them to any Target store to receive a full refund or contact Target Guest Relations at (800) 440-0680.

As a warning, Schlyer & Associates, Aggressive Trial Lawyers, a personal injury law firm located in Northwest Indiana advises the U.S. Consumer Product Safety Commission has issued a recall of 43,000 Circo Child Booster Seats sold at Target stores around the country.

The U.S. Consumer Product Safety Commission warns the booster seat’s restraint buckle can open unexpectedly, allowing a child to fall from the chair and be injured. This is an expansion of a prior recall.  This expanded recall involves all Circo Booster Seats, including those sold as early as 2005 according to the U.S. Consumer Product Safety Commission.

The recalled booster seats were only sold at Target stores nationwide from January 2005 through June 2009 for about $13.

If you have one of the recalled booster seats, you should immediately stop using the recalled booster seats and return them to any Target store for a full refund or contact Target at (800) 440-0680.

Dr. Promila Mehta Paul, our former personal injury client, is still missing.  The FBI, Highland and Munster, Indiana police departments need your help to locate her.

The U.S. Consumer Product Safety Commission with Delta Enterprise Corp.,  have re-announced a recall of 985,000 drop-side cribs due to another infant death.

The recall notice warns missing safety pegs can create a situation where the crib's drop-side rail disengages from the track. This can create a hazardous space in which an infant can become entrapped and suffocate.

This re-announcement pertains to cribs that were sold at major retail stores including Kmart, Target and Walmart between January 1995 and September 2007 for about $100.

Northwest Indiana Bankruptcy Attorney Discusses Basics for Filing an Affordable Bankruptcy

I was thinking about what it would be like to be a non-lawyer.  Don’t get me wrong, I love my job and I love helping people file for bankruptcy.  I love having the immediate satisfaction of stopping creditor harassment and collection phone calls. I believe sometimes, us so called “professionals” need to take a step back and walk a mile in the other shoe. I know a lot about bankruptcy and sometimes I forget that my client, while nervous, scared or even embarrassed, knows very little about the process of filing for bankruptcy.  It made me think, everyone should have some basic knowledge about bankruptcy and through a series of blogs, I want to share what I know.

Chapter 7 Bankruptcy

There are two basic types of bankruptcy available for people (not corporations).  A Chapter 7 is a liquidation of all unsecured debt with the option of retaining or returning secured property. That sounds very impressive and lawyer-like doesn’t it?  To say it another way, in a Chapter 7 you list all the debt you owe and you can keep the debt you decide to pay for, like a house or a car.  The other debts, like credit cards, medical bills, signature loans, payday loans and mail order things, are discharged (or forgiven)  and you would never have to pay those debts. If you decide you cannot afford to keep your house or a car, you have the option of giving the property back and owing that creditor nothing.

Chapter 13 Bankruptcy

A Chapter 13 is a reorganization of debt, a lot like credit counseling without the late fees, interest and collections.  In a Chapter 13 we put together a budget based on your net income and your everyday routine living expenses (not including your debts, mortgage or car payments).  This formula gives us an excess amount of income available for repayment of your debts.  Once we agree this figure is accurate, we file your bankruptcy and that amount is paid to a trustee on a monthly basis and he pays your debts for you.  He will focus first on secured debts, like a mortgage and cars. If he has money left over he will then make a distribution to your unsecured creditors.  While you bankruptcy is pending creditors cannot attempt to collect the debt.  At the end of your Chapter 13, your unsecured debts would be discharged and you would go back to making your mortgage payment.

Infant Slippers Sold Exclusively at Walgreens Recalled Due to Choking Risk

The Northwest Indiana law firm Schlyer & Associates warns parents of a recall issued by the U.S. Consumer Product Safety Commission regarding holiday rattle baby slippers.

About 57,000 slippers are recalled since internal stuffing and the rattle inside the slippers decorative figures can be pulled out, posing a choking hazard to young children, according to the recall notice.

According to the notice, the recalled slippers are decorated with stuffed fabric figures including snowmen, Santa, reindeer, and penguins, and have decorative rattles inside the slippers that sound like bells when shaken.

Fire and Fall Hazard - Wall Mounted Fireplaces Recalled

According to the recall notice published by U.S. Consumer Product Safety Commission, Colin Cowie Gel-Fuel Wood Fireplaces are recalled since heat from the operating unit causes the plastic mounting screws to deform causing the unit to fall from the wall, posing a fall and fire hazard.

Peanut Butter Recall Issued - Skippy Peanut Butter Affected Warns Attorneys

WARNING - Black ice may form on the roadways

What should you do if your vehicle encounters black ice?

1. If you feel your car starting to slide on black ice,  take your foot off the gas pedal. Do not give your car more gas, it can make matters worse.
2. DO NOT slam on the brakes. It could cause your car to slide more and make matters worse.  You could tap the brake pedal lightly.
3. If you feel your car starting to skid, turn the wheel in the direction of the skid.This should help to steer your car back on the right track.
4. As always, leave plenty of space between your car and the other cars on the road. Be sure to stay well behind the car in front of you - never tailgate

Where will you find Black Ice?

Black ice is usually found on roads that run around bodies of water(such as lake and rivers), in tunnels and in shady or rural areas. Be sure to take caution on bridges and overpasses.

Child Activity Center Toy Recalled Due to Choking Hazard

The Lake County, Indiana personal injury law firm, Schlyer & Associates, warns parents that the Parents® Busy Time Activity Centers™ have been recalled.  The product was manufactured by the Manhattan Group LLC, of Minneapolis, Minnesota.

According to the recall, issued in cooperation with the U.S. Consumer Product Safety Commission, wooden pegs on the xylophone activity can come loose, posing a choking hazard to young children.  To see a picture of the affected toy, please check this website.

The Activity Center is a wooden activity center cube-shaped toy that has a multi-colored bead run on the top. Activities on each side include a 4-tone xylophone and rasp, butterfly and caterpillar spinners, zig-zag drum, castanets, and pockets with "alligator," "bear," and "cat" pillow characters.  According to the recall, only items with wooden pegs bearing date code 400090GC are involved in this recall. The date code can be found on the bottom of the product packaging near the UPC code and on the tags on the bear character.

If you have an affected toy, you should immediately take the recalled toys away from young children and return it to the store where purchased for a full refund.  You can also contact Manhattan Group LLC for instructions on receiving a replacement item or a full refund.

Recall Issued for Baby Jogger Jump Seats - Fall Hazard

The Merrillville, Indiana law firm of Schlyer & Associates warns Baby Jogger LLC, of Richmond, Va. has issued a recall pertaining to their Baby Jogger Jump Seat.

According to the recall notice posted by the U.S. Consumer Product Safety Commission, if the Jump Seat does not properly lock into place, the Jump Seat could disengage from the stroller allowing the child to fall out, resulting in injuries.  The Baby Jogger was popular with many runners, as a easy way to bring children with on runs.

The Jump Seats were sold at various mass merchandisers and department stores nationwide and on the Web from January 2008 through July 2010 for about $100 according to the recall notice.

About 7,460 slow cookers (crock pots) sold by Burlington Coat Factory were recalled in cooperation with the U.S. Consumer Product Safety Commission.  According to the recall notice, the slow cooker's control panel can overheat and melt, posing a fire hazard.

Burlington Coat Factory sold the slow cooker at their stores, including their location in Hobart, Indiana, from June 2010 through December 2010 for $20.

According to the recall notice, if you own one of the recalled slow cookers, you should stop using the slow cooker immediately, unplug it and return the slow cooker to Burlington Coat Factory for a full refund or store credit.

Ford Issues Recall of 144,000 F-150 Pickup Trucks - Schlyer & Associates Advises

The cribs are sold under the name SNIGLAR.  The bolts used to assemble the cribs are not long enough.  The crib could collapse; there is a risk of causing the child to be trapped or suffocated.

The cribs were sold exclusively at IKEA stores from October 2005 through June 2010.  If you have one of the affected cribs, stop using the crib and contact IKEA immediately.
